Federal Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.

The case originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to face alien smuggling allegations, he was held in immigration detention.

In her order, the judge noted that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
